Draft of 9 October 2026 — sales closed
Provider and scope
CubixServ is operated by Paul Flores, individual entrepreneur, SIREN 828535310, SIRET 82853531000050, 6 rue du rempart romain, 30000 Nîmes, France. Contact: [email protected]; support through the client area.
These draft terms cover game servers, KVM VPS and their options. Dedicated servers, network protection and colocation require a separate quotation and specific terms, including equipment return where applicable. Customers must have legal capacity to enter into the contract or the required authorisation.
Service specification
The selected offer and order summary describe the resources, system or game, initial price, renewal price, term and options. Game resources are shared, subject to the advertised limits. VPS use KVM virtualisation. Unavailable configurations must be identified before payment.
Customers provide the publisher keys and software licences required for their use. Windows licences are supplied by customers. Evaluation images are labelled accordingly. CubixServ does not grant rights in third-party games, plugins or mods; compatibility depends on the actual configuration.
Account and ordering
Customers provide accurate billing details, verify their email and protect their credentials. Before confirmation, they can review and correct the selected service, options, period and total. They may pay directly or request an available trial.
Order confirmation and the accepted version of these terms are recorded in the client area and emailed. Capacity is checked before payment. A smaller configuration is never silently substituted for the selected offer.
Prices and payment
Prices are in euros. Setup charges, first-term discounts, total price and renewal price are shown before payment. The provider’s validated tax status appears on the order and invoice. The current configuration states that VAT is not applicable under article 293 B of the French Tax Code.
Only payment methods actually offered at checkout are available. The current panel does not automatically debit a saved card: renewal requires payment of a renewal order. Paid options are delivered after confirmed payment and infrastructure checks. Invoices and credit notes are available in the client area.
Delivery and term
Provisioning begins after confirmed payment and required checks when early activation has been explicitly requested. Otherwise, delivery follows the applicable withdrawal period. The agreed maximum delivery time must be shown before payment. Availability and expiry are shown in the client area.
Delivery incidents are reported and resolved without excluding statutory remedies. The ordered term applies. An already paid term cannot receive a retroactive price increase. A changed renewal price must be communicated before renewal, which the customer may decline.
Free 24-hour trial
When available, the trial provides the complete resources of the selected offer. Only one trial is allowed per customer. Multiple accounts or stolen identities may not be used to evade this rule. Anti-abuse checks are explained in the privacy information and do not silently reduce the advertised resources.
The 24-hour clock starts upon effective delivery. No automatic purchase or charge follows expiry. Customers may explicitly pay to keep their service. Otherwise it stops, and payment is due within 48 hours of trial expiry. Without payment, the service and associated data are deleted after the displayed deadline, subject to payment and notification checks. Start, expiry and deletion warnings are emailed. Customers must export their data before deletion.
Options, databases, backups and IP addresses
One backup slot and one database are included per game server when the relevant infrastructure is connected. An extra backup slot costs €5/month, an extra database €2/month and an additional VPS IPv4 €1.20/month, as confirmed in the order. Multiple IPv4 addresses may be requested, subject to availability and payment.
Options have their own expiry and renewal can be stopped in the panel. Expired IP addresses or those attached to a permanently ended service are removed and released after verification; customers do not own them. Expiry of a capacity option alone does not delete existing databases or backup files, but may prevent new creation. Final deletion of a service or trial also affects its associated data.
Backups and customer operations
Customers can create, download, restore and delete backups and schedule available operations. A backup must be marked complete before it can serve as a restore point. Panel safety copies for certain operations are separate from customer slots. Customers also keep an external copy of important data.
Restore, reinstall and file replacement can overwrite data. Their effects are explained before confirmation. SFTP access, ports and permissions are shared only with authorised persons. Collaborator permissions can be revoked. The provider remains responsible for its own breaches under applicable law.
Maintenance, support and incidents
Support covers the infrastructure, panel, delivery and service incidents. Daily game management, script development, operating-system administration and third-party software support are included only if specifically ordered.
CubixServ informs customers of planned maintenance and identified incidents and takes necessary corrective measures. A 100% uptime guarantee, fixed response time or particular compensation is only promised when expressly included in the offer. Statutory remedies for failure to perform remain available.
Acceptable use and security
Customers comply with law and third-party rights. Illegal content, impersonation, malware, spam, outgoing attacks and unauthorised access to other services or infrastructure are prohibited. Security testing requires authorisation from the system owner. Cryptocurrency mining is prohibited on ordinary offers unless separately agreed.
Technical controls are limited to necessary security and service management. An urgent suspension may protect other customers or meet a legal obligation. Reasons and available remedies are communicated where law and security permit. Suspension does not automatically remove statutory refund or other mandatory rights.
Service end and unpaid renewals
Customers can stop renewal through service settings. Service continues until its paid expiry unless a legal or security reason requires otherwise. The manually renewed panel does not impose an arbitrary 15-day cancellation notice. Unused time is not automatically refunded, subject to withdrawal, conformity and other statutory rights.
Expiry and nonpayment warnings explain deadlines and consequences. Suspension or IP removal follows the billing status. Final data deletion must be announced before it occurs; customers can export data while access remains available. Suspension must not be represented as completed deletion.
Consumer rights, withdrawal and complaints
Consumers generally have 14 days from conclusion of a distance service contract to withdraw without giving a reason. They can use the order’s withdrawal function or send a clear statement to [email protected] or the provider’s postal address. A dated acknowledgement is provided on a durable medium. Early activation consent is separate from acceptance of the terms and does not automatically remove withdrawal rights.
Where legally applicable and the necessary consents have been obtained, a proportional amount for the service actually supplied before withdrawal may be due. A legally due refund is made without undue delay within the statutory deadline, using the original payment method unless validly agreed otherwise. Example: “I withdraw from service contract [reference] concluded on [date]. Name, address, email and date.” Paper correspondence may be signed.
Mandatory rights, including digital-service conformity where applicable, remain protected. Complaints are handled through tickets and email. Following an unresolved written complaint, consumers may use the mediator actually appointed by CubixServ free of charge. The mediator’s name, postal address and website must be completed before sales open. Jurisdiction follows applicable rules; no exclusive Paris court is imposed on consumers.
Data, evidence and changes
Account data is used for service delivery, billing, support, applicable obligations and fraud prevention. Processing, retention, recipients and rights must be described in the privacy policy. Hosting personal data on a customer’s behalf also requires appropriate GDPR article 28 terms based on the real infrastructure and subprocessors.
Order logs and confirmations may provide evidence without preventing contrary evidence. The accepted version of the terms remains available. Later changes do not retroactively alter existing commitments. French law applies subject to mandatory consumer protections.
